Appellate court rejects Breivik’s appeal of appointment of new court psychiatrists
Anders Behring Brevik’s appeal of the Oslo District Court’s appointment of new court psychiatrists has been rejected by the appellate court (Borgarting Lagmannsrett).
Verdens Gang (VG) writes that Breivik’s lawyers are of the opinion that the Oslo District Court (Tingrett) has gone beyond its mandate when it appointed new psychiatrists before having access to the evidence in the case. According to Norwegian criminal law, it is the prosecutors that carry out the investigation until the trial begins, not the courts.
In its decision, the appellate court writes that the Oslo District Court has the ability to appoint new court psychiatrists, even if this is not requested by the prosecutors or the accused.
Breivik’s lawyers also argued that the Oslo District Court committed a procedural error when it used confidential psychiatric (i.e. medical) reports from Ila Prison as the basis for its decision. The appellate court rejected this argument deciding that the psychiatrist in question, Randi Rosenqvist, had officially been hired by Ila Prison not to offer Breivik treatment, but rather to evaluate the security situation.
VG also writes that the prison forwarded the confidential reports to the police who, in turn, forwarded them to the Oslo District Court.
Breivik’s lawyers have previously indicated they intend to appeal the appointment of the new court psychiatrists to the Norwegian Supreme Court if necessary.
